Parole-In-Place for Spouses of U.S. Citizens and Their Children

On June 18, 2024, President Biden announced a pathway to permanent residency and ultimately citizenship for undocumented spouses of U.S. citizens. The benefit would extend to the applicant’s children who are physically present in the U.S. without admission or parole as of June 17, 2024.
 

Eligibility 

To qualify, an applicant must:
  1. Be in the United States without admission or parole
  2. Have a legally valid marriage to a s. citizen as of june 17, 2024
  3. Be in the U.S. continuously for at least 10 years as of June17, 2024
  4. Not have a disqualifying criminal record
  5. Merit favorable discretion
 
 

The final rule and procedures for filing are anticipated to be announced towards the end of this summer. Applications sent prior to the application period will be rejected.
